{"id":32873,"date":"2026-02-24T00:33:31","date_gmt":"2026-02-23T14:33:31","guid":{"rendered":"https:\/\/woodcentral.com.au\/?p=32873"},"modified":"2026-02-24T01:03:32","modified_gmt":"2026-02-23T15:03:32","slug":"wheres-the-data-de-fegely-slams-samuel-review-for-weak-case-against-rfas","status":"publish","type":"post","link":"https:\/\/woodcentral.com.au\/wheres-the-data-de-fegely-slams-samuel-review-for-weak-case-against-rfas\/","title":{"rendered":"Where\u2019s the Data: De F\u00e9gely Slams Samuel Review for Weak Case Against RFAs"},"content":{"rendered":"\n<p>The former Chair of the Commonwealth Government\u2019s Forest Industry Advisory Council (FIAC) has delivered a blunt assessment of the Australian Government\u2019s Independent Review of the EPBC Act, arguing the 2020 Samuel Review is \u201cdeficient and underwhelming\u201d and provides no credible justification for dismantling Australia\u2019s Regional Forest Agreements (RFAs).<\/p>\n\n\n\n<p>Speaking to Wood Central following a key stakeholder meeting on Friday, Rob de F\u00e9gely AM, who from 2012 to 2017 was elected president of the Institute of Foresters for Australia (<a href=\"http:\/\/forestryaustralia.org.au\">now known as Forestry Australia<\/a>), said he felt \u201chonour bound\u201d to speak publicly because the Review examined forestry issues \u201con my watch and we were not made aware of it.\u201d<\/p>\n\n\n\n<p>de F\u00e9gely \u2014 who now chairs Sustainable Timber Tasmania and sits on the board of Forestry Corporation of NSW \u2014 stressed that his views are personal and independent of those organisations. Even so, he warned that the Commonwealth\u2019s decision to move away from RFAs has \u201ccreated massive uncertainty\u201d for staff, contractors and customers across public forest agencies.<\/p>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p>\u201cThe process that was announced on the 27th of November last year is fraught with challenges and, in my experience, probably unworkable.\u201d<\/p><cite>Rob de F\u00e9gely, the former Chair of the Commonwealth Government\u2019s Forest Industry Advisory Council (FIAC) who spoke to Wood Central today about the &#8220;deficient and underwhelming&#8221; report which gave justification for winding back the RFAs. <\/cite><\/blockquote><\/figure>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">The former chair of the body that advised the Australian Minister for Agriculture on proposed legislation and policies related to Australia&#39;s forests has slammed the review used by the Albanese government to justify EPBC reforms. For more: <a href=\"https:\/\/t.co\/t7yYUDW3Am\">https:\/\/t.co\/t7yYUDW3Am<\/a> <a href=\"https:\/\/t.co\/PZa2u8PrWH\">pic.twitter.com\/PZa2u8PrWH<\/a><\/p>&mdash; WoodCentralAu (@WoodCentralAU1) <a href=\"https:\/\/twitter.com\/WoodCentralAU1\/status\/2025865557380329864?ref_src=twsrc%5Etfw\">February 23, 2026<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<h6 class=\"wp-block-heading\">Three major flaws with the Samuel Review \u2014 and none justify dismantling RFAs<\/h6>\n\n\n\n<p><a href=\"https:\/\/www.dcceew.gov.au\/environment\/epbc\/our-role\/reviews\/epbc-review-2020\">Upon reviewing the 250\u2011page report<\/a>, de F\u00e9gely argued that the three forestry issues identified by the Samuel Review do not justify dismantling a system that has taken decades to build. <\/p>\n\n\n\n<p>The Friends of Leadbeater\u2019s Possum Inc v VicForests (2020) case, he said, reflected ambiguity in the law rather than systemic failure, noting that <strong>one court case in 25 years \u201cis a sign of a system that is working, not a broken one.\u201d<\/strong><\/p>\n\n\n\n<p>At the same time, he said the bill moved by Senator Bridget McKenzie removed the ambiguity, which is<strong> \u201cexactly how the RFAs were meant to work \u2014 a process of continuous improvement.\u201d <\/strong><\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<div class=\"youtube-embed\" data-video_id=\"TaZJZQX5BII\"><iframe loading=\"lazy\" title=\"\u2018Prepared to sell their souls\u2019: Labor \u2018rush\u2019 environmental laws striking deal with Greens\" width=\"696\" height=\"392\" src=\"https:\/\/www.youtube.com\/embed\/TaZJZQX5BII?feature=oembed&#038;enablejsapi=1\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/div>\n<\/div><figcaption class=\"wp-element-caption\"><em>In November, Bridget McKenzie claimed the EPBC Act was being \u201crammed through the Senate. The biggest changes to our environmental framework in decades are being rammed through. They wanted a win on the last day of parliament, and they were prepared to sell their souls to do it.\u201d<\/em><\/figcaption><\/figure>\n\n\n\n<p>The second problem cited \u2014 delays in completing RFA reviews \u2014 was, in his view, the<strong> result of implementation failures shared by the Commonwealth rather than evidence of a flawed framework.<\/strong><\/p>\n\n\n\n<p>Whilst he also rejected Samuel&#8217;s claim that the community does not trust the EPBC Act to deliver environmental benefits, describing it as a qualitative assertion unsupported by evidence, noting that public trust fluctuates across many institutions, from banks and airlines to supermarkets and politicians.<\/p>\n\n\n\n<p>None of the issues raised, he said, justify abandoning <strong>\u201c35 years of investment in time, effort and systems\u201d underpinning sustainable forest management.<\/strong> \u201cForestry is a long\u2011term business in which plantation decisions span 30 years and natural forest decisions often span a century.\u201d<\/p>\n\n\n\n<h6 class=\"wp-block-heading\">Show me the data: where is the baseline for national parks and reserves?<\/h6>\n\n\n\n<p>de F\u00e9gely argued that national parks and reserves lack formal annual reporting, leaving the Commonwealth without baseline data to measure \u201cnet gain\u201d in forest environments \u2014 a central element of the proposed reforms. And his concerns also extend to the Department of Climate Change, Energy, the Environment and Water\u2019s draft policy position, <strong>which he questioned how net gain could be measured without statistically valid monitoring of parks and reserves.<\/strong><\/p>\n\n\n\n<p>A single national standard, he said, cannot reflect the complexity of Australia&#8217;s diverse forest types, from Queensland&#8217;s<em> spotted gum<\/em> and <em>ironbark<\/em> to Western Australia\u2019s <em>jarrah <\/em>and <em>karri<\/em>. <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThere is a reason that 10 RFAs were established across four states \u2013 forests are complex systems, and there is no one-size-fits-all.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>The proposed new mitigation hierarchy \u2014 avoidance, mitigation, repair and offsetting \u2014 is already embedded in the RFA framework through the reserve system, Codes of Practice, certification and long\u2011standing offset arrangements. <\/p>\n\n\n\n<p>And while the Commonwealth&#8217;s $300 million support package is generous, de F\u00e9gely said it appears directed at processors rather than forest managers and therefore does little to improve environmental outcomes. <\/p>\n\n\n\n<p>\u201cI also do not believe that someone or an agency that calls for submissions via their website is undertaking genuine consultation.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">We&#39;re protecting the environment while speeding up approvals for housing and renewables. <a href=\"https:\/\/t.co\/82xKTzhAS9\">pic.twitter.com\/82xKTzhAS9<\/a><\/p>&mdash; Anthony Albanese (@AlboMP) <a href=\"https:\/\/twitter.com\/AlboMP\/status\/1993812694512881712?ref_src=twsrc%5Etfw\">November 26, 2025<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><figcaption class=\"wp-element-caption\"><em>The Albanese government announced the reform to the EPBC Act following marathon negotiations with the Greens in late November. <\/em><\/figcaption><\/figure>\n\n\n\n<h6 class=\"wp-block-heading\">&#8216;I never imagined it would come to this&#8217;<\/h6>\n\n\n\n<p>Reflecting on 50 years in forestry, he said he never imagined it would become \u201cso damn hard to produce in harmony with nature the world\u2019s most renewable product.\u201d Australia, he said, should be \u201changing its collective head in shame\u201d for importing wood despite being the world\u2019s seventh most forested nation.<\/p>\n\n\n\n<p>If the Commonwealth wants to improve environmental outcomes, de F\u00e9gely argued, it should focus on the top three threats identified in the State of the Environment report: stopping land clearing, investing in fire prevention and eradicating pest plants and animals, particularly cats and foxes. <\/p>\n\n\n\n<p>\u201cForest harvesting is a 10th-order issue.\u201d<\/p>\n\n\n\n<p>And that&#8217;s why F\u00e9gely is extending an invitation to the Prime Minister and federal ministers and officials to travel to visit Tasmania, and see Sustainable Timber Tasmania\u2019s management of more than 800,000 hectares of natural forest: \u201cYou will see forests full of wildlife, threatened species being actively managed, extensive eagle and swift parrot surveys, AI\u2011enabled fire detection, multi\u2011use forest management and the Tasmanian Forest Practices Authority\u2019s regulatory model in action.\u201d<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To find out more about the EPBC Act and it&#8217;s implications for Australia&#8217;s forests and forest products value chain, <a href=\"https:\/\/woodcentral.com.au\/albanese-sacrifices-forestry-in-last-minute-deal-to-beat-the-christmas-rush\/\">click here for Wood Central&#8217;s special feature.<\/a><\/li>\n<\/ul>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The former Chair of the Commonwealth Government\u2019s Forest Industry Advisory Council (FIAC) has delivered a blunt assessment of the Australian Government\u2019s Independent Review of the EPBC Act, arguing the 2020 Samuel Review is \u201cdeficient and underwhelming\u201d and provides no credible justification for dismantling Australia\u2019s Regional Forest Agreements (RFAs).
